A Sunday school teacher will face a judge on Wednesday after being accused of sexual battery on a child.
The alleged assault happened at a fair last weekend at the First Baptist Church of Pine Castle.
John Maxwell Ware, 53, of Orlando is charged with sexual battery on a child younger than 12. And he is being held inside the Orange County Jail on no bond.
He faced a judge on Tuesday, but he is expected to be back in court Wednesday afternoon. The judge on Tuesday gave him extra time to contact a lawyer.
According to an Orange County Sheriff’s Office arrest affidavit, a girl under the age of 12 and Ware were at the festival at the First Baptist Church of Pine Castle on Saturday when she asked to sit in Ware’s open car to rest.
After they sat in the stationary vehicle, the girl said Ware drove them toward the back parking lot and tickled her.
The girl claimed that Ware sexually battered her, but Ware stated that he did not and may have accidently touched her because, according to him, she was moving around so much because she was being tickled, the affidavit stated.
According to the affidavit, the girl told Ware to stop and move his hands away from her, but he did not and moved closer to the girl.
The church’s pastor told Spectrum News 13 they notified authorities as soon as they found out about the incident.
He says Ware was a volunteer worker who passed a background check.
